FishBeacon Terms of Use
These terms are an agreement between you and FishBeacon ("FishBeacon", "we", "us") for using the FishBeacon mobile app and website, including the map at fishbeaconusa.com (together, the "Service"). By using the Service or creating an account, you agree to these terms and to our Privacy Policy. If you don't agree, please don't use the Service.
Not for navigation - your safety comes first
FishBeacon is a fishing information tool, not a navigation or safety device. Water temperature, depth, wrecks, tides, wind, waves, forecasts, vessel positions and other data come from outside sources and computer models. They can be late, incomplete, inaccurate or unavailable, and depth shading is not a nautical chart.
Do not rely on FishBeacon to navigate, avoid hazards, decide whether it is safe to go out, or in an emergency. Always use official NOAA charts and forecasts, proper marine electronics, and good seamanship. In an emergency, call the U.S. Coast Guard on VHF channel 16 or dial 911. You alone are responsible for your vessel, your passengers and your decisions on the water.
You are also responsible for following fishing regulations, including licenses, seasons, size and bag limits, and closed or restricted areas. FishBeacon does not tell you where fishing is legal.
Who can use FishBeacon
You must be at least 13 years old to use FishBeacon. If you are under 18, you need a parent or guardian's permission, and they agree to these terms for you.
Your account
- Give accurate information and keep your password private. You are responsible for what happens under your account.
- One person per account. Don't use someone else's account or create accounts to get around limits or a ban.
- You can delete your account at any time in the app (Home → Account → Delete Account) or at fishbeaconusa.com/delete-account. Our Privacy Policy explains what is deleted.
Free accounts and subscriptions
FishBeacon is free to download. A free account has limits (for example, a set number of saved spots, catches and saved trips). A FishBeacon subscription, monthly or yearly, removes those limits and adds clubs, club spots and contests. Prices are shown in the app before you buy.
- Payment: subscriptions are bought through Apple (App Store) or Google (Google Play) and charged to that account. Their purchase terms also apply.
- Auto-renewal: a subscription renews automatically at the same price for the same period unless you cancel at least 24 hours before the current period ends.
- Cancelling: cancel in your Apple ID subscriptions or in the Google Play Store under Payments & subscriptions. You keep access until the end of the period you paid for. Deleting the app or your FishBeacon account does not cancel a subscription.
- Refunds: Apple and Google handle refunds under their own policies; we can't issue them directly.
- Price changes: if the price changes, Apple or Google will tell you in advance as their rules require, and you can cancel before it takes effect.
- Free access: we may give some users or club members free access. We can end free access at any time.
Clubs and fleets
A club or fleet admin can approve and remove members, run contests, and see member details described in our Privacy Policy. Admins are responsible for their club's name, logo, website, rules and contests, and for running contests fairly. Any prizes are offered by the club, not by FishBeacon, and FishBeacon is not responsible for them. Club admins must use members' information only to run the club.
Your content
You own the spots, catches, photos, tracks, logs and other content you add ("your content"). You give FishBeacon permission to store, copy, process and display your content only as needed to run the Service, including showing what you choose to share to your club. This permission ends when you delete the content or your account, except for copies kept for a short time in backups or as our Privacy Policy describes.
You are responsible for your content. Only add content you have the right to share.
Community rules and acceptable use
Don't use FishBeacon to:
- post offensive, hateful, sexual, violent, harassing or misleading content, or content that targets a person or group (see our community rules);
- stalk, harass or track another person, or share someone's location without their permission;
- break the law, including fishing and boating laws;
- send spam, run scams, or pretend to be someone else;
- scrape, copy or resell FishBeacon's data or maps, or use bots to access the Service;
- hack, overload or interfere with the Service, or get around its limits or security; or
- copy, change or reverse engineer the app, except where the law allows it.
We may remove content that breaks these rules, and may suspend or close accounts that break them, with or without notice.
Data from others
FishBeacon shows data from outside sources such as NOAA, NASA, Open-Meteo, GMRT, OpenStreetMap and public AIS vessel broadcasts. That data belongs to its providers and is shown as is. Not every vessel broadcasts AIS, so the vessel map does not show every boat.
Our property
The FishBeacon app, website, name, logo and design belong to FishBeacon. We give you a personal, non-transferable right to use the app and the Service under these terms. When you get the app from Apple's App Store, Apple's standard end user license terms also apply.
Changes to the Service
We keep improving FishBeacon, so features may be added, changed or removed. We may also pause or end the Service. If we end the Service, we will give reasonable notice where we can.
Ending your use
You can stop using FishBeacon and delete your account at any time. We may suspend or close your account if you break these terms or if we have to by law. The sections on safety, your content, our property, disclaimers, limits of liability, indemnity and governing law still apply after your account ends.
Disclaimers
THE SERVICE AND ALL DATA ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT THE LAW ALLOWS, FISHBEACON MAKES NO WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF ACCURACY, FITNESS FOR A PARTICULAR PURPOSE, MERCHANTABILITY OR NON-INFRINGEMENT. WE DO NOT PROMISE THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT IT WILL HELP YOU CATCH FISH.
Limits of our liability
TO THE FULLEST EXTENT THE LAW ALLOWS, FISHBEACON WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST DATA, PROFITS OR PROPERTY, OR FOR PERSONAL INJURY OR DAMAGE TO ANY VESSEL ARISING FROM YOUR RELIANCE ON DATA IN THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ABOUT THE SERVICE IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID FOR FISHBEACON IN THE 12 MONTHS BEFORE THE CLAIM, OR $50. Some places don't allow some of these limits, so they may not all apply to you.
Indemnity
If someone makes a claim against FishBeacon because of your content, your club or contest, or your breaking these terms or the law, you agree to cover FishBeacon's reasonable losses and costs from that claim, to the extent the law allows.
Governing law
These terms are governed by the laws of the State of New York, without regard to its conflict-of-law rules. Any dispute about these terms or the Service will be handled in the state or federal courts located in New York, and you and FishBeacon agree to those courts' jurisdiction. Before going to court, please email us so we can try to solve the problem informally.
Other terms
- These terms and our Privacy Policy are the whole agreement between you and FishBeacon about the Service.
- If part of these terms can't be enforced, the rest still applies.
- If we don't enforce part of these terms right away, we can still enforce it later.
- You can't transfer your rights under these terms. We may transfer ours, for example if FishBeacon is sold.
Changes to these terms
We may update these terms. We'll change the date at the top of this page, and for important changes we'll tell you in the app or by email. If you keep using FishBeacon after a change takes effect, you accept the new terms.
